terms and policies

Terms of Use

We know that this is the bit that you probably don’t want to read, but there is some important stuff in here, so you should read it all at least once. We may make changes to these terms from time to time, so please check back here as often as you can.

If there’s anything you don’t understand here (or anywhere else on the site), please get in touch with us. If you are under 18, please ask an adult to go through the following terms and conditions (on this page we call them Terms for short) with you and explain anything you don’t understand.

In Short

These Terms apply every time you visit Ask.fm. Here are the main points (although you should still read everything!):

  1. You are not allowed to register on Ask.fm or use the site unless you are 13 years old or over. Please do not lie about your age. By registering as a member, you agree to provide true and accurate information to Ask.fm. If you provide us with false information, we reserve the right to suspend or terminate your account.
  2. You alone are responsible for anything that you post or say while you are on Ask.fm – not us. We do not monitor everything on the Ask.fm site because it is not possible – we are not responsible for what users post on the site. However, we do sometimes get alerts when people use bad language or rude words – they are not acceptable on our site. We also follow up on all complaints we receive from anyone who reports a violation of these Terms and/or of our other policies, especially things which may have upset, distressed or scared them. So, if you post something that we think is inappropriate or unacceptable then we can remove it from the site and/or block your future access to the site where possible.
  3. If you post anything that belongs to someone else and they wish to do something about it, you will have to take responsibility for it. Again, you are responsible for what you post, even if you are posting anonymously.

Ask.fm is a place to chat with your friends and meet new people, to share your opinions and ideas. It is a fun place to visit – in order to make sure it stays that way, you must only use the site by keeping to these terms. We ask the same of everyone.

When you use Ask.fm (whether or not you are a member), you are making a binding legal agreement between you as someone who uses the site and us as the people who own the site. Ask.fm is currently operated through the company Sia Ask.fm (LLC) (the Company). The Company was registered on 29 June 2011 in Riga, Latvia and exists under the laws of Latvia. The Company’s registered office is at Zala ST 1, Riga, LV-1010, Latvia. Latvia is a member of the European Union. These Terms also apply to all other companies within the Ask.fm group which are involved in running the site.

By accessing, using, registering for or receiving any services on Ask.fm, you are automatically accepting and agreeing to these Terms.

If you do not accept and agree to the Terms then you must not access or use the site. By continuing to use or access the Ask.fm site, you are accepting and agreeing to these Terms.

Use of the site and rules relating to things you post/questions you ask

Who can use Ask.fm?

You may only use or become a member of Ask.fm if you are 13 years old or older. If you are under 13, you are not allowed to use this site. If it comes to our attention that you are using Ask.fm even though you are under 13, we will deactivate your account and attempt to block you from accessing the site.

You are responsible for making sure you follow all laws and regulations in the country you live in

By using Ask.fm, you are confirming that you have not been convicted of, nor are you subject to any court order relating to, assault, violence, sexual misconduct or harassment.

What kind of things can I post on Ask.fm? And what is not allowed?

You are able to post all kinds of things on Ask.fm, including text, photographs and videos.

Of course, we have some rules about what is acceptable - we have these rules so that everyone can enjoy using Ask.fm safely. You must not post or send anything which:

  1. is mean, is bullying someone or might harass, scare or upset anyone
  2. is deliberately designed to provoke or antagonise people, especially trolling
  3. uses rude words or which is likely to upset or embarrass anyone
  4. depicts horrible, shocking or distressing things
  5. is obscene or pornographic, contains any pictures of naked people, is sexually explicit or depicts graphic violence
  6. contains any threat of any kind
  7. is racist or mean or rude about someone’s race, religion, sexuality or the colour of their skin
  8. encourages people to get involved in anything which is illegal (for example, drugs, violence, or crime)
  9. is a lie about a particular person – either where you know it is untrue or where you don’t know for sure if it’s true (even if you think it might be)
  10. is spamming people or trying to sell them things or where you are trying to make money off other people
  11. doesn’t belong to you or which might breach someone else’s copyright (eg music or films) or confidentiality
  12. contains any computer virus or which is trying to damage our site
  13. is trying to get hold of or collect any personal or private information which we hold on Ask.fm
  14. pretends to come from someone other than you, or where you are impersonating someone else
  15. may cause any harm or damage to you or anyone else.

Use your common sense when posting anything, sending any question or making any comment on Ask.fm. Take a step back and think (especially if you are feeling angry) before you send it to check that it’s not something which is not allowed. Remember, you are solely responsible for everything you write or post on the site.

What are the rules relating to personal information?

You must not put any personal contact or banking information on your individual profile page whether in relation to you or any other person (for example, home address or postcode, telephone number, date of birth, email address, etc). If you give out any personal information about yourself to other members or users, it is at your own risk, so be careful. Bear in mind our Dos and Don’ts and Safety & Security Essentials at all times.

Can I use other people’s personal information?

You are not allowed to use other users’ personal information in order to try and make money, to spam, or to bully, threaten, upset, harass or embarrass anyone. We may, without notice, deactivate your account and/or block your access to the site where possible if we believe that you are misusing other users’ information.

If my friends want to see all the people I’m chatting with, can I tell them my password and allow them to log on as me?

No. Only you are allowed to access your account with Ask.fm. You must not tell anyone your password (even your closest friends or family members) or let anyone else access your account, as this might lead to all of your posts, messages and personal information being leaked or someone impersonating or pretending to be you. You are responsible for keeping your password secret and secure. If you don’t, Ask.fm is not responsible for anyone accessing your account or reading or sending messages from it. If you think that someone else might be using your account, you must let us know immediately. You should also immediately change your password. We are allowed to terminate your account or ban you from the site if you break the rules on keeping your password secure.

Who can see what I put on Ask.fm?

When you post or upload anything on Ask.fm it can be seen or accessed by the general public (not just registered members on Ask.fm). If you don’t want something to be seen by anyone else, then you shouldn’t post it on Ask.fm. We have the right (and without telling you beforehand) to remove or edit, limit or block access to anything that you upload or submit to Ask.fm. We do not have to display anything you submit to Ask.fm, or check whether what you post is correct or the truth. We are also not required to monitor the way you or anyone else uses the Ask.fm site.

Once I have uploaded anything on Ask.fm, do I still own it?

Yes, as long as you owned it in the first place. If you copied it from somewhere, then no – you must not post things that don’t belong to you. If you do this, Ask.fm will not be responsible and we reserve our right to claim against you in the event of any third party claims against us.

By posting anything on Ask.fm, you are (i) promising that you are allowed to post it and that you haven’t stolen it (ii) not pretending that you own it when really you don’t and (iii) allowing Ask.fm and any of our companies to use it in any way we like for as long as we want, free of charge.

If anyone says that something you wrote belongs to them or that you were not allowed to post it for whatever reason, if we think it is necessary we may delete that post. Similarly, tell us if someone else has posted something that belongs to you and we will look into it for you.

Access to Ask.fm

Will the Ask.fm site be up and running at all times?

Unfortunately we can’t guarantee that the site will always be working, because sometimes we have to carry out maintenance to the site or it may be affected by a fault or circumstances which are outside our control. We may at any time stop or suspend the site without telling you.

What about mobile access?

It’s up to you to make sure that you can access Ask.fm from your mobile (eg by speaking to your internet provider or mobile internet provider). We cannot guarantee that the mobile site will always work but of course our aim is that it will always be up and running and working perfectly.

By using Ask.fm on your mobile phone (and/or any other device) you might have to pay your internet or mobile service provider, so check with them first if you are not sure, as you will be responsible for any of those costs.

I’m not a member and I can’t seem to access some things on the site. Why is that?

Non-members are able to access only part of the Ask.fm site that is publicly available and do not enjoy all of the privileges of being a member.

Termination of use by us

My profile has disappeared and I can’t log in. What’s happened?

Sometimes people post things which we do not allow. If we think that you may be one of those people, then we are allowed at any time (without telling you in advance) to:

a. suspend/terminate your membership (where applicable) and your right to access and/or use Ask.fm or submit any content to Ask.fm; and

b. do anything else within our power or control to enforce our terms (including blocking specific IP addresses or telling the Police).

We will try to tell you in advance if your access to Ask.fm and/or your profile is going to be suspended or terminated, but we can’t guarantee that we will always be able to.

What do I do if I want to “unregister” myself from Ask.fm?

If you are an Ask.fm member, you can terminate your membership at any time by going to the Settings control on Ask.fm when you are logged in and choosing the ‘deactivate profile’ link. We save your profile information in case you change your mind later and want to re-activate your account. Many members deactivate their accounts for temporary reasons and in doing so expect us to maintain their information until they return to Ask.fm. You should therefore be able to restore your account and your profile.

For further details, please see our Privacy Policy.

Anything that you have uploaded to Ask.fm, other than your profile (such as questions or comments) will still appear on Ask.fm, even after you’ve terminated your membership.

Someone is doing things that are not allowed: who do I tell?

If anyone is bullying or harassing you (or anyone else) or doing any of the things that are not allowed on our website (eg posting horrible things, sending mean or hurtful messages), you can report it or complain about it by contacting us via our Feedback page. In order to help us help you, please tell us exactly what the problem is, in as much detail as possible. You can also report any user directly from a profile, by clicking the Report Button and choosing the reason for the complaint.

Do you have guidelines in place about what you can do with my personal data?

Yes, we process information in accordance with our Privacy Policy which is incorporated into these Terms. Please read it carefully before using Ask.fm.

Do the links on the site have anything to do with Ask.fm?

We may include on our site some links to other sites or things we think you might be interested in. Some users may also post links to outside website on their own or other users’ profiles. If you access any of these links they will take you to separate sites that are nothing to do with us. These sites will have their own terms and rules which may not be the same as ours, so you need to check them properly. We are not responsible for anything on those sites and we have no control over anything on them – it is totally up to you whether you want to visit them.

I have posted something that isn’t allowed and someone has said they are going to sue me. Can you sort it out for me?

No. If you write or upload something that is not allowed or which bothers or upsets anyone else then you are responsible for any consequences. So think carefully before you write or post anything on the site which you think might not be allowed. We are not responsible for what users write or upload on this site.

Are there any limitations on Ask.fm’s liability under these Terms?

Yes. Ask.fm’s liability under these Terms is limited as follows, to the fullest extent permitted by law:

We make no representation, warranty, and/or guarantee of the suitability of the Ask.fm website for your purposes, or that the use of the website will be secure, uninterrupted, error-free, free of viruses or other harmful components, or function properly in combination with any third-party technology, hardware, software, systems or data.

The Ask.fm website is provided “as is” and all conditions, representations, and warranties, whether express, implied, statutory or otherwise, including, without limitation, any implied warranty of merchantibility, title, fitness for a particular purpose, or non-infringement are hereby disclaimed to the maximum extent permitted by applicable law. Further, we make no representations or warranties of any kind, express or implied, as to the operation of the same, or to the information, content, communications, materials, or products and services contained therein. Your use of the Ask.fm website is at your sole risk.

We will not be liable for any damages of any kind arising from your use of the Ask.fm website, including, without limitation, direct, indirect, incidental, punitive and consequential damages. The laws of certain countries or states do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers, exclusions, or limitations may not apply to you, and you may have additional rights.

To be clear, nothing in these Terms will stop Ask.fm from being responsible or liable for anything which by law we must be responsible or liable for.

I have posted something that isn’t allowed and now someone has said they are going to sue Ask.fm.

If we are sued as a result of your use of Ask.fm then we have the right to defend or settle the relevant claim as we decide. If we ask, you will co-operate fully and reasonably as required by us in the defence of any relevant claim.

You agree to hold harmless and indemnify us and our officers, directors, employees, agents, representatives and licensors from and against any third party claims, damages (actual and/or consequential), actions, proceedings, demands, losses, liabilities, costs and expenses (including reasonable legal fees) suffered or reasonably incurred by us arising as a result of, or in connection with, your access to and use of Ask.fm, the uploading or submission of content to Ask.fm by you or your conduct, other than in accordance with the Terms or any applicable law or regulation. Ask.fm retains the exclusive right to settle, compromise and pay any and all claims or causes of action which are brought against us without your prior consent.

General Things

We have done what we reasonably can to ensure that everything on the site is up-to-date, but we cannot guarantee absolutely that it always will be. We don’t make any promises of any kind about the information contained on Ask.fm. Use of Ask.fm and the materials available on it is at your sole risk. Ask.fm cannot be held responsible for any loss arising from the transmission, use of data, or inaccurate content posted by users. You are responsible for taking all necessary precautions to ensure that any material you may obtain from Ask.fm is free of viruses or other harmful components. You accept that Ask.fm will not be provided uninterrupted or error free, that defects may not be corrected or that Ask.fm, or the server that makes it available, may not free of viruses or bugs, spyware, Trojan horses or any similar malicious software. Ask.fm is not responsible for any damage to your computer hardware, computer software, or other equipment or technology including, but without limitation damage from any security breach or from any virus, bugs, tampering, fraud, error, omission, interruption, defect, delay in operation or transmission, computer line or network failure or any other technical or other malfunction.

We reserve the right to modify, amend or change these Terms at any time. If we do this then the changes will be posted on this page and we will indicate the effective date of the updates at the bottom of these Terms. If we make any significant changes, we will contact you to let you know. You should regularly check this page to take notice of any changes.

If you do not accept any change to these Terms, you should stop using Ask.fm immediately. If you keep using the site following any change, you will automatically have accepted the change and you will be legally bound by the new updated Terms.

If, for any reason, any provision of these Terms are declared to be illegal, invalid or otherwise unenforceable by a court of a competent jurisdiction, then to the extent that term is illegal, invalid or unenforceable, it shall be severed and deleted from the Terms and the remainder of the Terms shall survive, remain in full force and effect and continue to be binding and enforceable.

The Terms set out the entire agreement and understanding between us and you in relation to your use of Ask.fm and supersedes all previous agreements, representations and arrangements between us (either oral or written). Nothing in these Terms shall limit or exclude any liability for fraudulent misrepresentation.

No failure or delay by us in exercising any right, power or privilege under the Terms shall operate as a waiver of such right or acceptance of any variation of the Terms and nor shall any single or partial exercise by either party of any right, power or privilege preclude any further exercise of that right or the exercise of any other right, power or privilege.

Nothing in the Terms shall confer or purport to confer any rights on any other third party.

These Terms and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes or claims) shall be governed by and construed in accordance with Latvian law and are to be subject to the non-exclusive jurisdiction of the Latvian Courts. In the event there is a discrepancy between this English language version and any translated copies of these Terms, the English version shall prevail.
